TERMS & CONDITIONS FOR THE CLINICAL ACADEMY AKA SHOPPMUBEAUTY 

(FOR THE PURPOSES OF THIS DOCUMENT REFERRED TO AS SPB)

COURSE BOOKINGS

  1. Bookings will only be accepted when made online at www.shoppmubeauty.com. For enquiries please email info@shoppmubeauty.com or call 0333 7777 689.
  2. If you make a course booking under the distance selling regulations and your course starts less than 14 days later, you agree to forfeit your rights to a refund in the event that you cancel your course.
  3. Once a booking and a payment has been made, any fees are not refundable after the cooling off period (14 days).
  4. Where course study material is sent (either by email or post) prior to the course in person training date, the course is deemed to have commenced upon receipt of study material as this is home course study.
  5. Courses booked in person or within 14 days of the start date do not qualify for the distance act rules. All course payments are non-refundable.
  6. Once we have processed your booking you will receive a course confirmation email with details of the course start/finish times and any specific instructions. Any bookings or orders can be found in your SPB account. Your place is guaranteed only when your payment has been received and you have received a booking confirmation. If you do not receive a booking confirmation please contact us by email at info@shoppmubeauty.com.

PAYMENTS & CANCELLATION

  1. All current course costs can be found by accessing the course you require at www.shoppmubeauty.com
  2. Payments can be made by:
  • Cash
  • Credit*/debit cards
  • Stripe
  • Paypal
  • Klarna
  • Bank transfer: NatWest, Sort code: 54-30-11 Account No: 35258527

Payment plans can also be arranged with SPB. Credit may be available to you subject to status. Full payment is required 14 days before commencement of your course or as per the terms of your Payment Plan.

*We do not process Amex credit card payments.

  1. All Payment Plan agreements must be adhered to, agreed and signed by SPB and the student. Failure to adhere to this may result in your course being cancelled until full payment has been made, temporary stop on any further training, no further action on marking of case studies/work, no assessment to complete your accreditation/qualification.  You will forfeit any payment already paid to the academy. Course fees include:
  • Tuition fees
  • Training materials/products used during lessons
  • Manuals and course material
  1. Additional fees may be required such as registration fees or assessment fee.
  2. If in the event of payment default, SPB will charge the following:
  • 1st payment default - £20 charge
  • 2nd payment default - £35 charge
  • Failure of payment after this will incur legal action at the student’s cost
  1. Students can make use of the café facilities that are open Monday-Friday. Refreshments will be provided. Students are also welcome to bring their own lunch.
  2. In the event of a student withdrawing from a course before completion or failing to attend the course without giving at least 15 days prior notice, the following fees will apply:
  • Courses over £300: A payment of £250 will be required to rebook for an alternative date
  • Courses under £300: Half of the course cost will be required to rebook for an alternative date
  1. Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, a student has the right to cancel a course booked within 14 days (known as a “cooling off period”) of entering into a contract. In this instance a full refund will be made to the student unless course material has been issued.  If the course commences within the cooling off period or the student has attended the course then the cooling off period is forfeit. If a student withdraws from a course within 15 days of commencement for whatever reason then the full fee will remain payable or any fees paid will be held.
  2. Any other items that will include further costs such as kits for home use will be charged as additional items unless specifically stated otherwise.
  3. On some courses, a tunic top is included in the course costs.
  4. On very rare occasions, due to circumstances, it may be necessary to reschedule or cancel a course upon which a booking is made.  SPB reserves the right to change a course date without compensation to a learner, although SPB will always endeavour to find a date to fit with a student’s diary.

WARRANTIES

  1. SPB warrants that the services provided under these terms will be provided with reasonable skill and care.
  2. The student warrants to SPB that:
  1. They are legally capable of entering into binding contracts, and have full authority, power and capacity to agree to these booking terms.
  2. That the information provided in or in connection with the booking request is accurate and complete.
  3. The student will be able to attend the course at the time and place advertised.
  4. The student meets the pre-requisites and qualification criteria for attending the course as specified in pre requisites.

GENERAL

  1. The student will ensure they attend every hour of the course on which they are booked. Course content is designed to meet the criteria set out by the relevant awarding bodies.  Failure to attend all the guided learning hours could result in the student not gaining the relevant qualification.
  2. Students must be 18 years or over at the time they commence a course at SPB unless otherwise stated.
  3. SPB will not guarantee any student will pass any test, examination or competence certificate. If during the test, examination or competency demonstration, the student does not meet the standards required by the governing body applicable to that skill, SPB cannot be held responsible.
  4. Courses may require practice on models at home plus written assignments to enable completion. Photo evidence may be required by the internal and external verifier.
  5. SPB reserves the right to decide on the number of students present on a course at any time.
  6. SPB reserves the right to refuse entry/enrolment onto any course or refuse education to a student booked on a course with valid reason.
  7. All course materials are copyright to SPB and will not be copied without permission.
  8. All students are required to adhere to Health and Safety, Student Conduct, Client Confidentiality, Data Protection and any other policy or regulation as set by SPB. These are available to students on request.
  9. Students will adhere to the dress code as directed by SPB.
  10. Tutors and assessors may change throughout the course without notice.
  11. The final decision on any assessment will be made by SPB, VTCT or any other awarding body.
  12. Students acknowledge that any work not submitted to the tutor for marking within the agreed study period will be subject to further fees. The student also acknowledges that some work will need to be to a standard recognised by external awarding bodies.
  13. It is the learner’s responsibility to study resources deemed appropriate to pass written and practical assessments and exams.
    Re-sit written exams will be charged for as follows:
    1. Written 1st attempt - Included in course fees
    2. Written 2nd attempt - Included in course fees
    3. Written 3rd attempt - £20.00
    4. Written further attempts - £25.00
    5. Practical 1st attempt - Included in course fees
    6. Practical further attempts charged at £75.00
    7. All re-sit exams will need to be booked into dates when the internal verifier is booked to attend.
  1. Home study of theory is required and is the student’s responsibility to do so in order to have the knowledge to pass assessments.
  2. Re-sits and re-takes of written or practical assessments will need to be taken at a time scale set by SPB to fit in with the internal verifier or external verifier. VTCT or ITEC in any discipline have an end point given by SPB at enrolment. Any completion passed the end date will be charged at a penalty of £150 + VAT for each day dedicated to student completion. Any re-sits required past a 2 year period need to be started again and will be charged at the full price of the qualification to do this.
  3. Failure to arrive for a pre booked assessment will be charged a re-arrangement fee £250 + vat per qualification.

COMPLAINTS

SPB endeavour to provide an exemplary service, however, any complaint about any aspect or experience at  SPB, should be made in writing toinfo@shoppmubeauty.com or to  SPB, 1000 Lakeside North Harbour, Portsmouth, PO6 3EN.  The complaint will be investigated and a response will be acknowledged within 7 working days with a resolution within a 30 working day period.

  1. LANGUAGE

The only language used by SPB is English. If you require your course literature to be translated then please discuss this at the point of booking the course or email info@shoppmubeauty.com at least 28 days prior to the start of the course.  SPB reserves the right to charge a fee for translation services.

  1. LAW APPLICABLE

These booking terms will be governed by and construed in accordance with English law, and the courts of England and Wales will have exclusive jurisdiction to adjudicate any dispute arising under or in relation to these booking terms.

  1. LIMITATION OF OUR LIABILITY

Nothing in these terms of use excludes or limits our liability for death or personal injury arising from our negligence, or our fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law.

To the extent permitted by law, we exclude all conditions, warranties, representations or other terms which may apply to our site or any content on it, whether express or implied.

We will not be liable to any user for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:

  • Use of, or inability to use, our site; or
  • Use of or reliance on any content displayed on our site.

If you are a business user, please note that in particular, we will not be liable for:

  • Loss of profits, sales, business, or revenue;
  • Business interruption;
  • Loss of anticipated savings;
  • Loss of business opportunity, goodwill or reputation; or
  • Any indirect or consequential loss or damage.
  1. NO RELIANCE ON INFORMATION 

The content on our site is provided for general information only. It is not intended to amount to advice on which you should rely. You must obtain professional or specialist advice before taking, or refraining from, any action on the basis of the content on our site.

Although we make reasonable efforts to update the information on our site, we make no representations, warranties or guarantees, whether express or implied that the content on our site is accurate, complete or up-to-date.

  1. PRODUCT WARRANTY
    1. For Products which do not have a manufacturer's guarantee, the Seller provides a warranty that Products shall be free from material defects for the following periods, commencing in each case on the date of the Dispatch Confirmation:

Leads: 90 days

Equipment: 1 calendar year

However, this warranty does not apply in the circumstances described in clauses 6.2 and 6.3.

6.2. The warranty in clause 6.1 does not apply to any defect in the Products arising from:

6.2.1. Fair wear and tear;

6.2.2. Wilful damage, abnormal or improper use, storage or working conditions, accident, negligence by you or by any third party;

6.2.3.    If you fail to operate or use the Products in accordance with the user instructions;

6.2.4.    Any alteration or repair by you or by a third party who is not one of our authorised repairers; or

6.2.5.    Any specification provided by you

6.3.       The warranty in clause 6.1 does not apply to

6.3.1.    Consumables, such as replaceable batteries;

6.3.2.    Any Product which has been opened or tampered with (except to replace batteries); or

6.3.3.    Any Product with an illegible serial number.

6.4.       If you are a consumer, this warranty is in addition to your legal rights in relation to Products that are faulty or not as described. You should take appropriate legal advice if in any doubt.

  1. CHANGES TO OUR SITE

We may update our site from time to time, and may change the content at any time. However, please note that any of the content on our site may be out of date at any given time, and we are under no obligation to update it.

We do not guarantee that our site, or any content on it, will be free from errors or omissions.

  1. CHANGES TO THESE TERMS

We may revise these terms of use at any time by amending this page. Please check the website page from time to time to take notice of any changes we made, as they are binding on you.

In placing an order for a course or products with SPB, the individual acknowledges and accepts all terms listed above.

      9. DELIVERY

Dispatch of orders is only Monday-Friday (excluding public holidays)

Order cut off for same day dispatch is 2:00PM Monday-Friday (excluding public holidays)

Orders placed after 2:00PM week days, at the weekend or on public holidays will be shipped the next available working day, (Monday-Friday, excluding public holidays)

Special delivery is only available for a Monday-Friday delivery and does not include Saturday, Sunday or public holiday deliveries. 

Collection is available from our Portsmouth location Monday-Friday 09:00-17:00 only or by special prior arrangement on Saturday. No collection is available on Sundays or public holidays.

The Royal Mail 48 service is not a tracked service.

SHIPPING TERMS

All our parcels are sent using the Royal Mail or other similar courier services. Signatures are not required as part of this service, parcel may be left in a safe place according to your instructions or may offer a different service based on your agreement with them. The Clinical Academy (TCA) is responsible for preparing and placing your order with our delivery ‘partner’. It is not responsible for your delivery or your receipt of orders. Any enquiries may be made to TCA who will then enquire with the delivery partner. You may need to contact the delivery partner directly to obtain further information depending on the place or country of delivery.

Although Royal Mail will endeavour to deliver orders within the time frames outlined above they/we cannot guarantee this due to delays out of our/their control. Compensation for loss will not be considered for an item that Royal Mail has not delivered or attempted to deliver until after

  • 10 working days for items other than Royal Mail Special Delivery Guaranteed by 1pm®, or
  • 5 working days for Royal Mail Special Delivery Guaranteed by 1pm® have elapsed from the due date of delivery, unless there is evidence to the contrary to demonstrate that the item has not been lost. Where an item is safely delivered after the 10 working days or 5 working days in the case of Royal Mail Special Delivery Guaranteed®) the customer will be entitled to claim compensation for delay but not for loss.

If a delivery charge for your area/country is not listed then we will give you a separate delivery quote and your order may take longer to arrive.

Orders are normally prepared and sent out the same working day if the order is placed by 2.00pm. Any orders placed after 2.00pm will be prepared and sent out the following working day. Orders with a request for next day delivery arrive the day after so please allow time for your parcel to arrive.

Shop PMU Beauty is responsible for preparing and placing your order with our delivery ‘partner’. It is not responsible for your delivery or your receipt of orders. The Royal Mail 48 service (also used for the free shipping service for orders over £35 not inc. VAT)  are not tracked. If you you prefer your parcel tracked, please choose an alternative service.

Any enquiries may be made to TCA who will then enquire with the delivery partner. You may need to contact the delivery partner directly to obtain further information depending on the place or country of delivery.

  • Orders are normally prepared and sent out the same working day if the order is placed by 2.00pm Monday - Friday only (excluding UK public holidays). Any orders placed after 2.00pm will be prepared and sent out the following working day, on Fridays this will be the following Monday. Orders with a request for UK mainland special next day delivery arrive the next working day so please allow time for your parcel to arrive.
  • If you live outside UK Mainland your order may take longer to arrive as the parcel will be passed to your countries postal carrier.
  • Smaller orders will be sent via Royal Mail, whilst larger orders may be sent via Parcel Force, UK Mail or DPD or other Courier. Shop PMU Beauty is responsible for preparing and placing your order with our delivery ‘partner’. It is not responsible for your delivery or your receipt of orders. Any enquiries may be made to TCA who will then enquire with the delivery partner.  You may need to contact the delivery partner directly to obtain further information.

All Products are subject to availability. Some orders may be special order and are labelled 'ordered on request' or pre-order and will be dispatched when they are received into stock.

Special orders or Ordered on Request items:

Once the order is made cannot be cancelled or returned for refund unless faulty. 

A contract is made between us and the Purchaser as follows:

  • the Products are placed on the Website as an invitation to treat only;
  • the Purchaser places the order on the Website by emailing us, clicking an order key or by calling us and this is your offer to purchase the Products;
  • once payment is received and cleared your offer to purchase the Products shall be deemed accepted.

If you have provided us with a valid e-mail address we will send you an acknowledgement of that order by e-mail. This will set out the Product(s) ordered.  Please note that this is not an order confirmation or order acceptance from us.

Your order may not be accepted for the following reasons:

  • the Product ordered is not in stock;
  • you are not a Registered Studio or Business;
  • you were not eligible to make an order in accordance with the Conditions;
  • you are not eligible under any relevant laws, regulations, statute or similar to purchase and/or sell the Products;
  • we could not acquire the necessary authorisation for payment or we discovered a problem receiving your payment;
  • there was an error with the description of the Products or matters relating to the Products.

We reserve the right to reject for any reasonable and lawful reason any offer to purchase by you at any time.
